If your daughter was worth much more than her partner (say possibly 30+ times more), had 2 children from a previous relationship, and you suspected an engagement was coming soon, what would you do?

This is the dilemma Kris Jenner reportedly finds herself in with daughter Kylie and her boyfriend Timothée Chalamet. Kylie has amassed an enormous fortune (including her business holdings) - but this could be at risk if Kylie got married then divorced.

Kris is no doubt aware of how a properly-drafted pre-nup. could protect Kylie’s assets.  But… actually getting this in place (i) in a relationship which is not yours, (ii) without upsetting your child or (iii) making things difficult in your child’s relationship in the run up to an engagement or wedding, is a difficult and delicate task.

Speaking frankly (but sensitively) to your child about your concerns is a good place to start. It can be helpful to have a family lawyer join those initial chats to clarify exactly what the child could possibly achieve with a pre-nup., the risks to them and their assets of not having one, and how the subject is best raised and navigated with the child’s partner.

It is a myth that only those with Kardashian-level-wealth could need a pre-nup. If you have assets you would want to try to protect from any divorce settlement, a pre-nup. would be a good thing to think about and get specialist family law advice on.
